Teori Maslahat Dalam Putusan Mahkamah Konstitusi

Abstract

This book tries to reconcile the legal problem of children born outside marriage after the issuance of Decision of the Constitutional Court Number: 46/PUU-VIII/2010 by using the Jurisprudence Proposal. In this book, the Author borrows an inclusive and progressive-responsive Theory Maslahat at-Thufi as his "Knife of Analysis". Theory which in the view of the Author has the same spirit with the principle that carried by the Constitutional Court.
