Imputación objetiva en la responsabilidad civil extracontractual: debate sobre el concepto de causalidad

Abstract

This book results from the collaborative work of several professors and students who participated in the seminar organized by the PhD in Law Program of the Universidad del Rosario in 2022, whose academic reflections focus on contemporary issues that are redefining the scope of a classical category in the legal order such as the obligation to compensate for the harmful consequences caused to the rights or interests of third parties by conduct attributable to a fully capable subject or performed by their agent for whose occurrence they have the legal duty to respond. This work includes contributions that address these novel issues from the perspectives of civil law, criminal law, labor law, administrative law, and international human rights law, based both on a re-reading of the classical paradigms of determining the structuring elements of liability and on an approach from more recent perspectives on the subject, such as the influence of International systems on the protection of rights in domestic regimes for their establishment.
