PENERAPAN KEADILAN RESTORATIF DALAM TINDAK PIDANA PENGGELAPAN

Abstract

Abstrak Keadilan Restorative adalah teori keadilan yang mengutamakan pada pemulihan kerugian yang disebabkan oleh perbuatan pidana. Pendekatan keadilan Restoratif memfokuskan kepada kebutuhan baik korban maupun pelaku kejahatan. Tujuan dalam penulisan ini adalah menganalisa keadilan restorative dalam tindak pidana penggelapan. Pendekatan yang digunakan dalam kajian ini adalah dengan menggunakan pendekatan normatif,dimana bahan-bahan pustaka dan undang-undang menjadi sumber utama.Hasil penelitian ini menunjukan bahwa konsep pendekatan restorative justice sebagai alternatif penyelesaian tindak pidana segera diterapkan di Indonesia sebagai upaya pembaharuan hukum. Hal ini dikarenakan restorative justice merupakan suatu pendekatan yang lebih menitik-beratkan pada kondisi terciptanya keadilan dan keseimbangan antara pelaku tindak pidana dengan korban. Munculnya konsep keadilan restoratif bukan berarti meniadakan pidana penjara, dalam perkara-perkara tertentu yang menimbulkan kerugian dan kerusakan, maka pidana penjara masih dapat dipergunakan. Konsep dari keadilan restoratif yang berfungsi sebagai ekselerator dari asas peradiilan sederhana, cepat dan biaya ringan, sehingga dapat terpenuhinya kepastian hukum dan keadilan bagi masyarakat. Kata Kunci : Keadilan Restorative, Tindak Pidana, Penggelapan Abstract Restorative justice is a theory of justice that prioritizes the recovery of losses caused by criminal acts. Restorative justice approaches focus on the needs of both victims and perpetrators of crime. The purpose of this paper is to analyze restorative justice in the crime of embezzlement. The approach used in this study is to use a normative approach, where library materials and laws are the main sources. The results of this study indicate that the concept of a restorative justice approach as an alternative to criminal acts is immediately applied in Indonesia as an effort to reform the law. This is because restorative justice is an approach that focuses more on the conditions for creating justice and a balance between the perpetrators of crimes and the victims. The emergence of the concept of restorative justice does not mean abolishing imprisonment, in certain cases that cause loss and damage, imprisonment can still be used. The concept of restorative justice which functions as an accelerator of the principle of justice is simple, fast and low cost, so that legal certainty and justice can be fulfilled for the community.
