Acceso a la justicia de las personas con discapacidad y ajustes de procedimiento

Abstract

Access to [ustice is an essential instrumental right, since ir acts as an basic element \nro enforce the other rights. In relation to people with disabilities, ir means being \nable to use legal mechanisms under equal conditions, which wiU favor the exercise of \ntheir rights. It will be essential to make «procedural accornmodations», which seek to \nadapt actions and procedures so that the justice environment responds to the needs \nof each person wirh a disabiliry, thus reducing obstacles and avoiding defenselessness. \nThey are introduced into civil ptoceedings through the new art. 7 bis LEC and the \nidentical precept incorporated inro the LJV \nTwo recent rulings of the Constitutional Court can be seen as tacidy allowing \nfor adjustments in civil proceedings.
