Abstract

A research in primary subject studying the power of legislative in forming of the constitution before and after the amendement of 1945 Indonesian Constitution has one of its purpose. That purpose is to find out the different in forming of the constitution between The legislative and The President before and after the amandement of the 1945Indonesian Contitution thus we can identity the change of the power position from The President's domination to the pattern of cooparation.The method used in research is historical judical and political theory. The substance in the research in normal ative law and in the end, the result concluded deductively.The conclusion of the research is the exsistence of judicial guarantee to thr increasing of the role of The Legislative in matter of Representative. There are some obstance in order to increasing the role of The legislative and also how the efforts of increasing the role of The Legislative informing constitution after the amendments made.
