KEADILAN RESTORATIF ( RESTORATIVE JUSTICE ) SEBAGAI ALTERNATIF PENYELESAIAN PERKARA TINDAK PIDANA

Abstract

Sistem peradilan pidana di Indonesia saat ini cenderung mengarah pada tujuan retributif yaitu menekankan keadilan pada pembalasan. Para hakim cenderung menjadikan pidana penjara sebagai sanksi utama pada para pelaku tindak pidana yang terbukti bersalah di pengadilan.Penjatuhan Pidana merupakan reaksi atas tindak pidana dalam wujud nestapa yang dijatuhkan kepada si pembuat tindak pidana oleh negara melalui putusan pengadilan. Penjatuhan pidana yang pada awalnya bertujuan untuk pembalasan (retributif) terhadap pelaku kemudian bergeser menjadi bertujuan untuk ganti rugi (restitutif) oleh pelaku kepada korban. Dan selanjutnya bergeser lagi menjadi bertujuan untuk pemulihan keadaan seperti semula (restoratif). Restorative justice sebagai alternatif penyelesaian perkara tindak pidana yang dalam mekanisme tata cara peradilan pidana, berfokus pada pemidanaan yang diubah menjadi proses dialog dan mediasi yang melibatkan pelaku, korban, keluarga pelaku/korban, dan pihak lain yang terkait.Kata Kunci : Keadilan, Restoratif, MediasiThe criminal justice system in Indonesia currently tends to aim at retributive goals, namely emphasizing justice on retaliation. The judges tend to make imprisonment as the main sanction for the perpetrators of criminal acts who are proven guilty in court. Criminal conviction is a reaction to a criminal act in the form of sorrow that is imposed on the perpetrator of the crime by the state through a court decision. Criminal imposition which was initially aimed at retributive to the perpetrator then shifted to aim at compensation (restitution) by the perpetrator to the victim. And then it shifts again to aim at restoring the situation to normal (restorative). Restorative justice as an alternative settlement of criminal cases which in the mechanism of criminal justice procedures, focuses on punishment which is converted into a dialogue and mediation process involving the perpetrator, victim, family of the perpetrator/victim, and other related parties.Keywords: Justice, Restorative, Mediation
