Abstract

The progress of social life, science and technology has resulted in the development of forms of crime. This research aims to analyze criminal responsibility for perpetrators of criminal acts of corruption, and analyze the judge's considerations in deciding the case. The type of research used is "Normative Juridical" research, and is descriptive analysis, the research approach uses a statutory approach, a case approach, a conceptual approach. The legal material collection technique used is qualitative. The results of this research show that the Ambon District Court Panel of Judges sentenced LI as the Head of the Ambon City Environment and Waste Service. The judge's basic consideration in imposing a sentence using article 2 paragraph 1 against LI was that there was a year-end bonus payment so that the judge was of the opinion that the elements of article 2 paragraph 1 had been fulfilled.
