The Constitutional Court is facing one of the biggest crises in its history, due to the constant politicization of the body, based on the justifications that are made when appoin-ting magistrates and, thanks to a legal system that does not require too many requirements when carrying out the function: be a lawyer of recognized competence and have fifteen years of professional practice. In this work, its legiti-macy will be questioned based on the lack of independence and neutrality of its magistrates and the constant detriment of the collegiate nature of the body due to the practices that take place within it. Also, it will come to be argued that we have a dysfunctional Constitutional Court due to the past personal situations of its magistrates, both political an institutional, based on the doubts that are displayed regar-ding its legitimacy
