A crise do estado de direito e o direito administrativo

Abstract

[POR] O presente estudo tem por objetivo analisar a crise do Estado de Direito e a relação que esta mantém com a Administração Pública e o Direito Administrativo. Para o alcance dessa finalidade, analisaremos e conceituaremos, preliminarmente, as diferentes formas de exercício do poder Político, o Estado e, naturalmente, o próprio Estado de Direito. Em relação a esse modelo estatal, apresentaremos os aspectos essenciais da sua evolução histórica e os elementos ontológicos que o definem, diferenciando-o de outros modelos estatais inseridos no âmbito do Estado moderno. A partir daí, buscaremos demonstrar que a crise que o atinge, praticamente desde o seu nascimento, mantém uma relação direta com os problemas, tensões e conflitos motivados pela evolução histórica da sociedade capitalista. Ficará demonstrado, ainda, por força da relação umbilical que o Direito Administrativo mantém com o Estado de Direito, que a crise atualmente vivenciada por esse particular campo do Direito não passa de ser um reflexo direto da própria crise que atinge aquele modelo estatal. Nesse ponto, enquanto motivos que propulsionam a crise que atinge o Estado de Direito, suas Administrações e o Direito Administrativo, analisaremos os problemas suscitados, em especial nas últimas décadas, pela afirmação hegemônica do pensamento neoliberal e pela globalização. Por fim, após analisarmos as formas de negação do Estado de Direito em diferentes períodos da sua existência, apresentaremos a proposta de um novo tipo de Estado de Direito. Essa proposta incorporará uma perspectiva de radicalização democrática, a ser desenvolvida e institucionalizada, ainda, nos marcos a sociedade capitalista moderna. [EN] The present study aims to analyze the crisis of the Rule of Law and its relationship with Public Administration and Administrative Law. To achieve this goal, we will first provide preliminary analysis and definitions of the different forms of exercising Political power, the State and, naturally, the Rule of Law itself. Concerning this state model, we will outline the essential aspects of its historical evolution and the ontological elements that distinguish it from other state models within the modern State context. Subsequently, we aim to demonstrate that the crisis it has faced since its inception is directly linked to the problems, tensions, and conflicts brought about by the historical evolution of capitalist society. Furthermore, we will show that, due to the integral connection that Administrative Law maintains with the Rule of Law, the current crisis experienced in this specific field of law is nothing but a direct reflection of the crisis afflicting the state model. To explore the reasons driving the crisis affecting the Rule of Law, it’s Administrations, and Administrative Law, we will analyze the issues raised, particularly in recent decades, due to the dominant influence of neoliberal thought and globalization. Finally, after examining instances of denial of the Rule of Law throughout different periods of its existence, we will present a proposal for a new form of Rule of Law. This proposal will incorporate a perspective of democratic radicalization, which will be developed and institutionalized, within the framework of modern capitalist society.
