Nilai-Nilai Kearifan Lokal dalam Masyarakat Adat dalam Pemilihan Legislatif di Papua

Abstract

Papua as one of the provinces in Indonesia has its own way of choosing legislative members at the regional level which is different from the implementation of the election of other regional legislative members in Indonesia. The main objective of this study is to determine the mechanism for the general election of regional legislators in Papua based on the value of local wisdom of the Papuan people as regulated in positive law in Indonesia. The findings in this article are found that the construction of law in the modern democratic process implemented by the state through compromise methods in the implementation of popular sovereignty as a constitutional mandate in Indonesia is one of the solutions for implementing democracy through legislative elections in Papua.
