Análisis del marco jurídico para la reparación colectiva a grupos étnicos en Colombia: caso comunidades negras del Chocó

Abstract

Members of ethnic groups or ethnic minorities have become the main victims of Colombia’s internal armed conflict, their territories being the favorite scenarios of the different armed groups, a situation that creates a humanitarian crisis. In this article, through an analytical – descriptive documentary research, different legal provisions issued on reparations to identify the scope, relevance, advantages and disadvantages of regulations governing collective reparation for black communities are examined. It was shown that the legal instruments regulating collective reparation for these communities, are not effective, then, the institutional weakness prevents these instruments from responding to the historical, social and cultural context of black communities.
