PENERAPAN SANKSI PIDANA BAGI PELAKU TINDAK PIDANA ANAK

Abstract

ABSTRAK Anak merupakan amanah dan karunia Tuhan Yang Maha Esa yang memiliki harkat dan martabat sebagai manusia seutuhnya. Perlakuan hukum pada anak sudah selayaknya mendapatkan perhatian serius, karena anak adalah masa depan suatu bangsa. Dalam perkara pidana Nomor 50/Pid.B/2009/PN.Btg terdakwa adalah anak yang masih berumur 15 tahun, didakwa melakukan perbuatan sebagaimana diatur dan diancam pidana dalam Pasal 363 ayat (1) ke-4 jo Pasal 65 ayat (1) dan ayat (2) KUHP. Hakim menjatuhi pidana penjara selama 6 (enam) bulan dan terdakwa dikembalikan kepada orang tuanya sebagaimana mestinya. Putusan tersebut tidak mencerminkan kepastian hukum bagi terdakwa serta tidak mengedepankan pemidanaan sebagai ultimum remidium . Kata kunci: peradilan anak, sanksi pidana, ultimum remedium . ABSTRACT Children are the mandate and grace of God Almighty. They have dignity and worth as fully human beings. Legal treatment of children should receive serious attention, because children are the future of the nation. In the criminal case number 50/Pid.B/2009/PN.Btg, the defendant, a 15-yearold boy, was charged with conduct, and punishable as provided in Article 363, paragraph (1) to (4) jo Article 65 paragraph (1) and (2) of the Criminal Code. Judges imposed imprisonment for 6 (six) months to the defendant and later returned him to his parents as he should . The decision did not seem to reflect the rule of law or legal certainty of the defendant, and did not address criminal sanction as the ultimum remidium.
