Fungsi Evaluatif Filsafat Hukum terhadap Hukum Positif Indonesia

Abstract

Filsafat hukum sebagai teori dari keilmuan hukum merupakan meta teori tentang teori hukum; dan sebagai meta-meta-teori dari dogmatik. Oleh sebab itu, dogmatik hukum, teori hukum, filsafat hukum pada akhirnya harus diarahkan kepada praktik hukum. Praktik hukum menyangkut dua aspek utama yaitu pembentukan hukum dan penerapan hukum. Penelitian ini bertujuan untuk menganalisis aktualisasi filsafat dalam pencarian kebenaran hukum positif Indonesia dapat ditinjau dari beberapa hal, yaitu: hukum sebagai asas kebenaran yang bersifat kodrati dan berlaku universal, hukum adalah norma-norma positif di dalam sistem peraturan perundang-undangan hukum nasional, hukum adalah yang diputuskan oleh hakim, hukum sebagai pola-pola perilaku sosial yang terlembagakan dan hukum adalah manifestasi makna-makna simbolik para pelaku sebagaimana tampak dalam interaksi mereka. Pancasila sebagai jalinan nilai filsafat dan hukum ditinjau dari tiga kenyataan berikut: kenyataan riil berupa ruang lingkup kajian dan isi, nilai dasar, universal, komprehensif dan metafisis. Sebagai sistem filsafat dan hukum, Pancasila juga mengandung nilai-nilai keagamaan dan martabat manusia; kenyataan fungsional praktis adalah sebagai sistem nilai yang mengutamakan prinsip kepercayaan kepada Tuhan, renungan tingkah laku sebagai pandangan hidup bangsa, sebagai sistem filsafat, Pancasila merupakan jalinan nilai-nilai dasar yang bersatu padu (inherent) dan sebagai sumber filsafat negara atau weltanschauung atau idiologi, Pancasila merupakan maha sumber bagi negara dan bangsa Indonesia. Legal philosophy as a theory of scientific law is a meta-theory of legal theory, and the meta-meta-theory of dogmatic. Therefore, dogmatic law, legal theory, legal philosophy should ultimately be directed to the practice of law. The practice of law involves two main aspects, namely the establishment of law and application of the law. This study aims to analyze the actualization of philosophy of law in the search for truth in Indonesian positive law can be viewed from several things, namely: the law as the foundation of truth that is natural and universal validity, the law is positive norms in the legislation system of national law, the law is decided by the judge, the law as patterns of social behavior is a manifestation of institutionalized and legal meanings of symbolic actors as they appear in their interactions. Pancasila as the fabric of values and legal philosophy in terms of the three following fact: the real true scope of the assessment form and content, the value of the basic, universal, comprehensive and metaphysical. As a system of philosophy and law, Pancasila also contains religious values and human dignity; functional practical reality is as a value system that promotes the principles of belief in God, devotional behavior as a way of life of the nation, as a system of philosophy, Pancasila is the fabric of the basic values cohesive (inherent) and as a source of state philosophy or Weltanschauung or ideology, Pancasila is a great resource for the state and nation of Indonesia.
